Terms of use & cancellation

1. Who runs the site

The site www.shivha.co.il is run by the Ofek LaChaim association in memory of Ofek Taub z"l (registered nonprofit 580582716), in memory of Ofek Refael Taub z"l. All the tools on the site are provided free of charge, with no ads and no fees.

2. The paid service – eulogy writing with artificial intelligence

• The package includes 3 eulogy drafts, for use within 7 days of payment. Price: 29 ₪, including VAT where applicable. The binding price is the one shown on the payment page.
• The draft is written by an artificial-intelligence model (Claude, by Anthropic), based only on the details you provided in the form.
• The draft is a suggestion only. It is your responsibility to read it, correct it and make sure it is accurate and appropriate before reading it aloud or publishing it.
• A draft that failed because of a technical fault is not deducted from the package.
• The template draft on the same page remains free and does not require payment.

3. Payment and receipt

• Payment is made on the secure page of Grow (Meshulam). Card details do not pass through the site and are not stored on it.
• Payment methods: credit card, Bit, Apple Pay and Google Pay, subject to availability.
• The receipt for the eulogy package is issued by the association. This is a payment for a service and not a donation, and therefore it does not qualify for a tax credit under section 46 of the Israeli Income Tax Ordinance. (Memorial page – see section 6.)
• The income supports the association's activity and covers the cost of the service.

4. Privacy

• The name, phone number and email given for payment are passed to Grow for billing and the receipt only. The site keeps only an order ID, the amount and the number of drafts remaining.
• The answers in the eulogy form are sent to Anthropic's model (servers in the USA) to write the draft and are not stored on the site. They are saved on your device only, so that you do not have to type them again. You can delete them with the "Delete all my data from this device" button at the bottom of every page.
• The most recent draft is saved with the order, so that you can recover it if the connection drops. The order data, including the draft, is deleted from the server no later than 30 days after the order was last used.

5. Cancellation and refunds

• You may cancel the transaction and receive a full refund within 14 days of payment, as long as no draft in the package has been written.
• Once a draft has been written, the service is considered to have been provided, and cancellation is possible in accordance with the Israeli Consumer Protection Law, 5741-1981.
• A technical fault because of which no draft was received entitles you to a full refund.
• For cancellation requests and questions, contact the association: Ofek LaChaim (registered nonprofit 580582716), by e-mail at arsionoltd2026@gmail.com or through the association's website ofekor.co.il. In a cancellation request, quote the order ID shown on the eulogy page.

6. Memorial page

• The memorial page is published in return for a donation to the Ofek LaChaim association of 180 ₪ a year (365 days from the donation). The binding amount is the one shown on the Grow payment page. The association issues a donation receipt. A tax credit under section 46 of the Israeli Income Tax Ordinance is subject to the approval the association holds at the time of the donation.
• The page includes a photo, name, dates (civil and Hebrew), a life story, quotes and a candle wall where visitors light a candle and leave a short message. Lighting a candle and writing a message are free and not conditional on anything.
• Renewal: towards the end of the year a renewal notice appears on the page. A renewal is a further donation of the same amount and extends the page by another year from the end of the previous period (or from the day of renewal, if it has already expired).
• Expiry: for 30 days after the end of the period the page stays visible with a renewal notice. After that it is hidden from visitors but not deleted, and the family can renew it at any time.
• Responsibility for content: whoever creates the page declares that they are entitled to publish the details and the photo, that the page is in memory of a person who has died, and that the content is not offensive, inciting, misleading or in breach of others' rights. The family approves (or removes) every visitor message and may remove any message at any time.
• The association may hide, without refund, a page or a message that breaches these terms or the law, and may pass details to the authorities as required by law.
• Privacy: the content of the page is visible to anyone with the link and may appear in search engines. The contact email is not shown. The name and phone number for payment are passed to Grow only. The order ID and payment date are kept with the page as long as it exists; the other order details are deleted from the server within 30 days.
• Cancellation: you may cancel and receive a full refund within 14 days of payment, as long as the page has not been published (activated). Once published, the service is considered to have been provided, and cancellation follows the Israeli Consumer Protection Law, 5741-1981. In a cancellation request, quote the order ID or the page address.

6a. Memory collection

• The memory collection (/en/memories/) is a free service: the family opens a collection, and whoever receives the link writes a memory and attaches photos. The content reaches the family only, unless the family opens a "memory wall" – then memories the family approved are shown to whoever holds the link. The collection does not appear in search engines.
• Responsibility for content: whoever writes a memory or uploads a photo declares that they are entitled to publish them, that the photo does not violate others' privacy, and that the content is not offensive, inciting or infringing. The family may hide or delete any memory; the association may hide content that breaches these terms.
• Privacy: the name, relation and the memory are shown to the family, and on the wall if it was opened. A participant's phone and email are visible to the family only. Photos are resized and stored without location or device data, outside the site folder. Whoever sent a memory can delete it within 24 hours, and afterwards through the family.
• Retention and deletion: the content is kept on the server for 365 days from the opening of the collection plus 30 days of grace, then deleted automatically. The family can extend by a year, download everything (printable book, photo file) or delete the collection immediately. The portal does not guarantee backups – download your material.

6b. Live gatekeeper

• The gatekeeper (/en/gatekeeper/) is a free service: the family opens a status page for the shiva house and updates its current state; whoever holds the link sees it. Only what the family wrote (family name, the deceased's name, address, hours, links) and the status are stored – no data about visitors. The page does not appear in search engines.
• The address and visiting hours are visible to whoever holds the link. Send it only to those who need it. The admin link goes to one or two people only; whoever holds it can change the status and details.
• The page is deleted from the server 30 days after the last update, or immediately at the family's request ("Delete the page now").

6c. Equipment orders and supplier matching

• The equipment-order service (/en/order-equipment/) passes the family's request to the nearest registered supplier in the index, and if they do not confirm within 10 minutes – to the next one. It is a referral only, with no payment and no commission: the portal is not a party to the deal, does not recommend any supplier, does not vet suppliers beyond approving the listing, and is not responsible for availability, price, service quality or arrival. The agreement, price and payment are between the family and the supplier only.
• "Confirmed" in the supplier portal means the supplier tapped confirm; it is not a commitment by the portal. Call the supplier and settle details and price in writing.
• Privacy: name, phone, town, street (if given), items, time and notes are shown only to the supplier the request was offered to and to the site editors. The request is not in search engines and is deleted from the server 30 days after creation, or at once on the family's request (cancel). An unconfirmed request expires after 48 hours.
• Suppliers: listing is free and not conditional on a donation. A registered supplier agrees to receive requests by e-mail and WhatsApp from families, undertakes to confirm only orders they can fulfil, and declares that the details given are correct. The nonprofit may remove a supplier from the index at any time. The supplier-portal link is personal – do not pass it on.

6d. Death notice as a shareable picture

• The notice generator (/en/death-notice/) runs on the device. Whoever chooses "link with picture preview" uploads only the notice image (not the form) to the server; it is available to whoever holds the link for 30 days and is then deleted. It can be deleted earlier with the delete link shown once. The page is not in search engines.

The content on the site is meant to help and does not replace medical, mental-health, legal or halachic advice. In an emergency – the crisis lines are here. For questions of halacha and custom, it is recommended to consult your community rabbi.
